Definitions

Art for Planet Earth (“We”, “Us”) – a not-for-profit Unincorporated Association that operates an online platform dedicated to showcasing and promoting environmentally inspired artwork, hosting art competitions and facilitating the sale of artwork.

Artist (“You”) – a creative person that has submitted a work of art to an exhibition in the gallery or to a competition.

Buyer – a person or entity that goes through the buying process for a work of art listed on the Art for Planet Earth website.

These Artist Terms & Conditions apply when you list an artwork for sale on the Art for Planet Earth website. By marking a work as available and completing a sale, you agree to these terms in addition to our general Terms of Use.

1. Eligibility to Sell

You confirm that you are the creator and legal owner of the artwork or have clear authority to sell it. You warrant that the work is free from third-party claims and is safe, authentic, and accurately described.

2. Listing Details

Artists must provide accurate information about the artwork, including medium, dimensions, condition, and pricing. You agree to update us promptly if the work becomes unavailable or if any details change.

3. Our Role

Art for Planet Earth provides a web-based platform for artists to sell their work to a buyer. We act as a go-between and as such the contract of sale is directly between the artist and the buyer. Funds flow via Art for Planet Earth and are held in escrow until the buyer confirms safe receipt and acceptance of the work of art.

4. Pricing & Commission

The sale price is set by the artist at the time of submitting a work of art. The price can be varied at any time prior to an expression of interest by a potential buyer. Platform commission and any applicable fees will be deducted from the final sale proceeds. The standard commission charged by Art for Planet Earth is 20% of the sale price. Other fees may be applied if notified to the artist in advance.

5. Payments

Payments are processed via Stripe or other secure payment provider. Funds will be transferred to the artist minus commission and fees within 14 business days after delivery is confirmed and the work is accepted by the buyer.

6. Delivery, Packaging & Insurance

Unless otherwise agreed, the artist is solely responsible for safely packaging and shipping the artwork to the buyer. The artist is also responsible for timely shipping, insurance and any damage during transit. Art for Planet Earth takes no responsibility if the buyer rejects the work of art for any reason.

7. Cancellations & Returns

Set out your policy for order cancellations, cooling-off periods, and returns. If returns are accepted, specify the conditions (time limits, artwork condition, responsibility for return shipping) and how refunds are processed. An administrative fee may be charged to the artist for the charges associated with returns.

8. Unsold Works

If an artwork does not sell, clarify whether it should remain listed, be removed after a set period, or be withdrawn from sale at the artist's request without penalty.

9. Taxes & Reporting

Artists are responsible for complying with their own tax obligations, including VAT or income tax where applicable. Art for Planet Earth does not provide tax advice.

10. Copyright & Usage

Artists retain copyright unless expressly transferred. By selling through the platform, you grant Art for Planet Earth a non-exclusive licence to display and promote the artwork images for marketing and archival purposes.

11. Conduct & Compliance

Listings must not violate any laws or third-party rights. We may suspend or remove listings that appear fraudulent, infringing, unsafe, or inappropriate for the platform.

12. Changes to these Terms

We may update these Terms periodically. Continued listing or selling of artworks after updates constitutes acceptance of the revised terms.
